Marriage License Laws
In Illinois and Wisconsin, you must obtain your marriage license in the county in
which you will be married. In Indiana,
you obtain a license in the county in which you live. A license obtained in one county
is not valid in another.
For those outside of the Chicagoland
area (Wisconsin, Indiana, etc.), you are responsible for finding out if there
are any restrictions on a minister from Illinois marrying you in your county
and for informing me of any procedures required.
To receive a marriage license, both applicants must be present and proof of age is
required. Be prepared to furnish one of the following: a valid driver’s license, an original
or certified copy of your birth certificate, a military ID (with photo and signature), or a
passport.
The legal age without parental consent is 18 for both persons. If age 16 or 17, both parents,
or legal guardians of both applicants, must be present to sign consent. Written, notarized
consent is also allowed.
If either party has been divorced, a certified copy of the divorce decree or an
original signed by the judge must be presented.
There is a one-day waiting period required between application and the ceremony. Each county
requires that the marriage be performed within 30 or 60 days after the license is issued.
The fee is $30 in Cook County and $15 in other counties-fees subject to
change. No blood test is required. Call one of the numbers below for more
information.
No signatures by bride or groom are required in any of the following counties EXCEPT
McHenry. The marriage is NOT valid until the officiate performs the ceremony and signs the
license.
No witness signatures are required on the license in any of the following counties
EXCEPT DuPage. After the ceremony, the license is given to the officiate who signs and mails
it to the appropriate office within 10 days. The county then records your marriage and a
certificate can be issued 2-4 weeks after your wedding. To receive a copy of your marriage
certificate, you must apply for it from the location where you obtained your license.
The cost is typically $7 for the first copy and $2 or $3 depending on the county. It
is highly recommended that you obtain three.
